An un-registered operator of an Internet pharmacy who offers services to facilitate healthcare transactions, but does not meet the definition of a healthcare provider and thus is not required to possess a healthcare professional license, may wish to consult the online pharmacy host at which they may be hosted, and/or the international branch of the Unites States pharmacists’ section of the American Pharmacy Association (APhA) for advice. Most online pharmacies that are hosted by a not-for-profit educational institution or the host’s representative provide help in understanding legal rules and best practices, and help in preventing one from violating the law.
The pharmacy associated with each incident shall be the provider of the covered service. The Board shall grant the application to renew a pharmacy license if the pharmacy meets the following conditions: Is operating in accordance with the Board's emergency directive; Has adequate supplies of all essential medicines and patient-dispensing supplies; Has adequately trained and screened employees and adequately informed eligible patients regarding the benefits and risks of vaccination; Is properly licensed and in compliance with all other applicable laws and regulations; and Does not offer health services to the public.
The Board may grant the application to renew a pharmacy license if the pharmacy meets the following conditions: Is operating in accordance with the Board's emergency directive; Has adequate supplies of all essential medicines and patient-dispensing supplies; Has adequately trained and screened employees and adequately informed eligible patients regarding the benefits and risks of vaccination; Is properly licensed and in compliance with all other applicable laws and regulations; Does not offer health services to the public; and Does not hold an A-3 license.
The Board shall not grant an application to reactivate or renew a pharmacy license if the pharmacy meets any of the following conditions: Is being held in a State of Emergency by the Board, but will not be in violation of any provision of the Board's emergency directive on or before March 3, 2021; Is in substantial violation of the Board's emergency directive on or before March 3, 2021; or Is not operating in accordance with the Board's emergency directive on or before March 3, 2021.
