Jemi Terms of Service
Description of Service
Jemi.so is a platform that is designed to allow anyone to register for an account ("Account Holder") to create and update an online web site & store. The Account Holder can customize their site(s) with images, text and video and use their site to facilitate the acceptance of monetary donations and/or sell virtual services and physical goods.

While we may help facilitate the resolution of disputes, Jemi has no control over and does not guarantee (i) the truth or accuracy of any descriptions of sold items on Jemi, or (ii) the performance or conduct of any Member or third party.
By using Jemi, you agree to these terms.
An Account Holder is defined as someone who registers a Jemi page or uses our Jemi platform in any way to create a website, and/or receive payments and/or sell different types of digital services and goods (video calls, video responses, text messages, etc).
To be eligible as an Account Holder, you must be the older of: (i) 18 years, or (ii) at least the age of majority in the jurisdiction where you reside and from which you use the Services to open an Account.
All Jemi Account Holders are solely responsible for all text, images, videos, links and other content that you create, upload, post, and share to others using Jemi.
As an Account Holder, whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you warrant that you have the necessary authorization to provide this information. You will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
Any content you upload to our website will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content but you grant us and other users of our site a limited license to use, store and copy that content and to distribute and make it available to third parties. We may use this content to improve our site and our business without liability to you.
You also grant us the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.
We have the right to check and remove any content or posting you make on our site if, in our opinion, this is reasonably necessary to protect our business.
As a Jemi Account Holder, you are responsible for keeping your password secure. Jemi cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.
We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, our users and the public.
We reserve the right to report illegal activity to applicable local authorities.
Things that we don't allow:
Any activity that violates any law or governmental regulation industry requirements or money laundering regulation.
Anything prohibited by the payment providers connected to the platform such as PayPal Inc and Stripe. For the avoidance of doubt the acceptable use and prohibited activities can be found at• https://www.paypal.com/en/webapps/mpp/ua/acceptableuse-fullhttps://stripe.com/gb/prohibited-businesses
Content including but not limited to:
- Adult or sexually explicit content including but not limited to: Pornography, nudity and any other obscene content, Literature, imagery (including illustrative), videos, links to external sites or content containing such material, Sexual services such as prostitution, escorts, pay-per view, adult live chat features
- Content including links to and from the platform which is fraudulent, misleading, inaccurate or dishonest
- Phishing content (content with motive to trick users into providing their username and password or downloading malware)
- Violent or excessively gory content; and
- Hate speech, intimidation or abuse of any kind targeting any individual, group or institution.
- Abuse of any kind targeting any individual, group or institution;
- Activity purposefully designed to harm the Account Holder in any way including financial harm with tactics such as chargebacks or fraudulent disputes;
- Transactions for the sale of items or goods with the purpose of avoiding paying taxes;
- Products or services that directly infringe or facilitate infringement upon the trademark, patent, copyright, trade secrets, or proprietary or privacy rights of any third party;
- Any other activity that Jemi may deem in its sole discretion to be unacceptable.
In other words, do not use Jemi.app for Illegal, Adult content, or Hate Speech. Please only use Jemi.app in legal, genuine and positive ways.
Things we are not responsible for
Jemi is not and should not be held liable for any damages or losses related to your use of the Services. We don’t become involved in disputes between users, or between users and any third party relating to the use of the Services. We don’t oversee the performance or punctuality of pages and contents, and we don’t endorse any content users submit to the Site. When you use the Services, you release Jemi from claims, damages, and demands of every kind — known or unknown, suspected or unsuspected, disclosed or undisclosed — arising out of or in any way related to such disputes and the Services. All content you access through the Services is at your own risk. You’re solely responsible for any resulting damage or loss to any party.
Specific Use Cases
Building a simple website & landing page
All Jemi Account Holders can use Jemi to set up a simple website for their personal use and/or business. Each Account Holder is able to create and manage multiple Jemi sites.
All cancellations and refunds for Live events are handled by the Account Holder and their client.
Jemi is not responsible for the fulfillment (shipping & handling) of physical items sold on Jemi. Jemi is not responsible for any damaged items. If there is a defect in an item or an item has not been received by the fan, they may request a refund or a re-shipment from the Account Holder, but we are not liable for replacing or refunding these placed orders.
About our fees and payment
Jemi Account Holders can choose between a free and paid plan for each specific site they create and manage on Jemi. If you create a websote that is successfully supported, we collect a small commission from your earnings. Here's what you get when you create an account:
1. Create and customize your unique Jemi page
2. Ability to add "items" to sell to their audience
3. Ability to receive payments through “items" you sell on Jemi
4. Ability to receive "tips" from fans once a request has been completed
5. Ability to add links and content directly to your Jemi page
You’re responsible for paying any additional fees or taxes associated with your use of Jemi.
Except when required by law, paid Subscription fees for Jemi plans are generally non-refundable. However, we reserve the right to do so in our sole and absolute discretion.
Jemi reserves the right (but is under no obligation) to cancel your Jemi request if: (i) your payment method is declined; or (ii) you have previously been banned or removed from our Site for any reason. Jemi also reserves the right at any time to change its fees and payment procedures, including its payment options and terms, either immediately upon posting on our Site or by other notice to you.
About other websites and links
Jemi may contain links to other websites. (For instance, user websites pages, user profiles, and comments may link to other sites.) When you access third-party websites, you do so at your own risk. We don’t control or endorse those sites.
Jemi partners with Stripe for payment processing. When you support or create a page, you’re also agreeing to the payment processor’s terms of service.
About account termination
You can terminate your account at any time. We may retain certain information as required by law or as necessary for our legitimate business purposes. All provisions of this agreement survive termination of an account, including our rights regarding any content you’ve already submitted to the Site. (For instance, if you’ve launched a page, deleting your account will not automatically remove the page from the Site.) You can contact us at firstname.lastname@example.org for additional information or to request page deletion (this is not available in all circumstances).
Agreement Between You and Us
These Terms are the entire agreement between You and Jemi with respect to the Services. They supersede all other communications and proposals (whether oral, written, or electronic) between you and Jemi with respect to the Services and govern our relationship. If any provision of these Terms are deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. Jemi's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
We may modify or discontinue the Services at any time, in our sole discretion. You agree that, except as otherwise expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Jemi’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
